The newest revision of the bill drafted by Assemblyman Charles Calderon that proposes a tax on the adult entertainment industry in the state of California shows a lowering of proposed tax to 8.3 percent.

According to a report on AVN.com, this latest draft of the bill was submitted last Thursday. When the democratic assemblyman last submitted the bill, the proposed tax on the adult industry was 25 percent. Those businesses that would fall under the umbrella of the tax include strip clubs, XXX video emporiums and other business that sold adult products and services. Other changes in the bill include that the proposed tax would be levied on the “gross receipts from the sale of qualified tangible personal property, as defined, of a qualified business whose gross receipts from the sale or rental of adult material exceed 50 percent of all gross receipts of the retail establishment.” The previous version of the bill called for a tax on any business whose gross receipts from adult material exceeded 10 percent of the total gross receipts.

The bill was, and continues to be, criticized heavily by adult industry lobbyists as well as many republicans for its promotion of selective taxation.

The AVN.com story points out that Calderon’s first introduced his proposed tax on the adult industry ten years ago, and the bill was defeated. This latest bill was put in the “suspense file” and put on hold in May 2008 when it was last brought before the Assembly Revenue and Tax Committee.
