U.S. District Judge Susan Bucklew denied granting Max Hardcore (aka Paul Little) a new trial for “distributing obscene materials.” Hardcore and his attorneys had petitioned for a new trial for several reasons, but the judge ruled that any alleged irregularities involving various jurors did not affect the verdict, and that Max was given a fair trial.

Some of the reasons they gave for a new trial included a juror being fired from her job the night before the verdict, and the claim that a federal prosecutor reported that he “engaged in an inadvertent, but prejudicial dialogue with a juror in the elevator.” The defense motion said that, “the attorney questioned whether the juror was going upstairs to ‘watch that porn,’ and the juror affirmed that he was.

Sentencing is due September 5th. To read is scheduled to be sentenced Sept. 5.
